“Getaway $100-A-Day–Giveaway”
Winners: One (1) Prize winner will be selected daily, by Davis McDowell Inc. located at 8030 La Mesa Blvd. #271, La Mesa, CA 91941. The prize winner will be notified by email at the email address he/she listed on the question and answer form. In the event of a tie, the winner will be determined by first entry as determined chronologically by date stamp as well as proof of the correct answer by the contestant and announced no later than 9:00 a.m. P.S.T the morning following the contest entry date. All contestants will automatically be entered into the monthly, quarterly and annual “Super Getaway Giveaway” as described below.
“Monthly Getaway-Giveaway”
Winners: One (1) Prize winner will be selected on the first Monday of the month from the pooled contestants of Daily contestants as described above from the preceding month. The prize winner will be notified by email at the email address he/she listed on the question and answer form from the daily giveaway drawings. Both winners and non-winners alike will be entered into the Monthly Getaway-Giveaway. The winner will be determined by random drawing conducted by Davis McDowell, Inc. The prize winner will be notified by email at the email address he/she listed on the original question and answer form for the $100-A-DAY-Giveaway.
“Quarterly Getaway-Giveaway”
Winners: One (1) Prize winner will be selected quarterly from the pooled contestants of the monthly entrants as described above in the monthly giveaway program. One (1) Prize winner will be selected on the First Monday of the Quarter following the preceding 3 month period. This Monday may correspond with the Monthly Prize drawing. Both winners will be announced concurrently. Prizes will be announced as per the 9:00am P.S.T. schedule aforementioned in the Daily and Monthly programs.
“Super Getaway-Giveaway”
Winners: One (1) Prize winner will be selected from all of the above pooled contestants from the corresponding calendar year by an officer of Davis McDowell Inc. One (1) Prize winner will be selected on the First Monday of the Year following the preceding 12 month period. This Monday may correspond with the Daily, Quarterly and Monthly Prize drawings. All winners will be announced concurrently. Prizes will be announced as per the 9:00am P.S.T. schedule aforementioned in the Daily and Monthly programs. The Super Getaway Giveaway may have other restrictions and procedures to be announced at least three months prior to Drawing.
ELIGIBILITY: As of date of entry, participants must be at least 18 years of age. Officers, directors, employees and shareholders of Sponsor and/or marketing partners and their corresponding immediate families thereof, are not eligible to participate in Getaway Giveaway programs. “Immediate family” means only spouses, parents, and children. These Programs are subject to all applicable federal, state and local laws and regulations.
TO ENTER: To enter, contestants must complete the required fields of the Email entry form, answer the “Question of the Day” correctly as determined by Officers of Davis McDowell, Inc. and by doing so agree to receive future electronic advertisements as well as contest notifications and status from www.getawaypackages.com. The contestant must complete the required fields of the entry form and click on "submit." Entries must be received by Sponsor no later than
9:00PM P.ST. the day of the contest to be eligible for the daily “Giveaway”.
Sponsor and Davis McDowell, Inc. their subsidiaries, affiliates, consultants, agencies and employees are not responsible for incorrect, inaccurate or incomplete transcription of entry information; lost, stolen, late, or misdirected entries; destruction or alteration of entries; unauthorized access to entries; human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software failure, inability to access any web site or online service, or any other error or malfunction, or any entries that for any reason are not received by Sponsor by the above time and dates. Proof of sending an entry will not be deemed to be proof of receipt by Sponsor.
PRIZES: Four (4) Prizes will be awarded, one daily in the amount of $100 USD as described above. Sponsor reserves the right to substitute a prize of equal or greater value. Winner will be responsible for any state and local government taxes (sales, state, federal and/or local income) derived from the Getaway Giveaway Programs and use or acceptance of the Prize(s) are the sole responsibility of the winner. Prizes may not be extended, redeemed for cash (unless prize is advertised as such,) transferred or substituted.
SELECTION OF WINNER: Subject to the eligibility requirements in these Official Rules, the contestant whose entry is selected based on first receipt of correct Answer to the Daily Question will win the $100 Prize. Sponsor will notify each winner by Email, return receipt requested, addressed to the Email address provided on contestant’s entry form. Before receiving any prize and as a condition of receiving prize, each winner will be required to provide winner’s name and address as it appeared on the entry form, as well as social security number and proof of residency. Each Winner must sign an Affidavit of Eligibility & Release supplied by Sponsor, which, among other things, releases Sponsor and its subsidiaries, directors, agents, agencies, affiliates, advertisers, promoters, officers, directors, employees and related persons from any and all liability related to giveaway programs and Prize. Winner must return these documents no later than 14 days of receipt. Winner may be required to sign other legal documents (including tax forms) or show additional proof of eligibility. If winner fails to sign and return the documents within 14 days of receipt, or fails to meet any eligibility requirement, an alternate winner will be chosen by random drawing, to be held as soon as reasonably practicable. Alternate winner is subject to all eligibility requirements and restrictions of these Official Rules.
MISCELLANEOUS: Sponsor and Davis McDowell, Inc. shall be entitled to interpret these rules as needed, all decisions are final. Sponsor reserves the right to cancel, at its sole discretion, terminate or suspend part or all of these Giveaways, should any virus, non-authorized intervention, telecommunications or computer failure, malfunction, or other cause beyond its reasonable control, corrupt or impair the security, administration fairness and/or operation of this Program. In such event, a drawing will be conducted to award the Prize using all entries received as of the time of cancellation, termination, modification or suspension. Sponsor reserves the right to correct typographical, clerical or printing errors in any Giveaway materials. Sponsor and its subsidiaries, affiliates, consultants, agents and employees will not be liable for any injury, loss, damage or liability of any kind (including but not limited to damage to computer equipment) resulting from participation in these Giveaway programs, downloading, or the acceptance or use of the Prize. Any person suspected of defrauding or tampering with these Programs in any way will be ineligible and may be prosecuted to the full extent of the law.
